Should additional requirements arise as a result of LGR, the total estimated Framework value may increase to a maximum of £107,325,000 million EX VAT. Stage 1 - Invitation to Participate This will be the PSQ stage that suppliers complete such as their economic and financial standing and their technical/ professional ability. The Council will also ask scored and weighted questions to arrive at a shortlist of a maximum four highest scoring suppliers for each lot to take to Stage 2. Stage 2 - Invitation to Submit Final Tenders Suppliers successful from Stage 1 will be invited to submit their tenders which will consist of their pricing, quality and social value methodologies. The values attributed to individual lots are indicative only and do not represent any guarantee of expenditure. Actual spend may vary between lots depending on operational requirements, available funding and any changes arising from LGR. Call-off contracts may include highway maintenance works, specialist highway services, traffic management, supply of materials, plant and equipment hire, haulage services and resource support. Requirements may range from small-scale reactive works to larger planned maintenance and capital improvement schemes. Appointment to the Framework does not guarantee any minimum value or volume of work. Call-off contracts may be awarded by direct award and/or further competition in accordance with the Framework terms and procurement documents.

Supply and installation of Road Markings, High Friction Surfacing and Road Studs. The core value of this lot is £950,000 EX VAT over the 4 year term. The value plus any options (LGR) is £1,425,000.00 over the 4 year term. Options: Local Government Reorganisation The Contracting Authority has identified Local Government Reorganisation (“LGR”) as a potential future event which may affect the delivery and/or administration of the Services during the Contract Term. LGR may result in changes to local government structures, administrative boundaries, functions, responsibilities, service delivery arrangements or the identity of the organisation responsible for the Services The Contract may therefore require modification as a consequence of LGR. Where permitted by the Procurement Act 2023, such modifications may include consequential changes to the scope, geographical coverage, volumes, service requirements, governance and reporting arrangements, and/or arrangements for the transfer of responsibility for the Services to a successor or reorganised local authority. Any modification will be limited to changes permitted under the Procurement Act 2023, including where applicable Schedule 8, and will not change the overall nature of the Contract. Local Government Reorganisation (LGR) proposals continue to be developed across a number of areas and may result in changes to council structures, service delivery arrangements, responsibilities and geographical coverage during the term of this contract. Whilst the final outcome and implementation arrangements remain subject to government decisions and further local development, it is possible that the effects of LGR could lead to changes in service demand and/or the need to extend provision to additional areas, organisations or client groups. The Authority therefore reserves the right to vary the scope and value of the contract to reflect any future changes arising from LGR. For further information, please refer to the Government's Local Government Reorganisation updates: https://www.gov.uk/government/collections/local-government-reorganisation-policy-and-programme-updates The core framework value across all lots is estimated at £72,000,000 (Excluding VAT) based on current known service requirements. Due to the potential impact of the Local Government Reorganisation this value may rise. Therefore, the total contract value may rise to £108,000,000 (Excluding VAT) £129,600,000 (Including VAT). These figures are estimations and due to only being in the early stages of the process the Council cannot give any commitment on these figures but would like to build scope into the Contract should the need arise. Bidders should take this identified risk into account when preparing their Tender and pricing. Innovation and Product Development The Council recognises that products, materials, technologies, techniques and methods of delivery within the scope of this Framework may develop during the Framework Term. The Framework is intended to accommodate appropriate developments and innovations within the existing scope of each Lot. Contractors and suppliers may therefore propose new or improved products, materials, technologies, techniques or solutions where these: Fall within the scope and intended purpose of the relevant Lot; meet or exceed the applicable technical, performance, safety and regulatory requirements; represent an improvement or development of the type of works, products, materials, technology or solutions contemplated by the Framework; do not materially alter the overall nature or scope of the Framework or the relevant Lot; and can be procured through the Framework in accordance with the Procurement Act 2023. The Council may consider such developments when undertaking Call-Offs under the Framework, where permitted by the applicable Call-Off procedure. The inclusion of this provision does not guarantee that any innovative product, technology or solution will be purchased by the Council. A contractor/supplier introducing a new or innovative product or solution shall not acquire an exclusive right to supply that product or solution through the Framework. Other contractors/suppliers shall be able to offer equivalent or alternative solutions. These can only be accessed via the use of a further competition.

Procurement Act 2023

Competitive flexible procedure

Individual Call off Contracts will be awarded via the Framework in accordance with one of the following procedures Direct Award (Basket of Rates) Direct Award (Ranked Order) Further Competition Framework Providers will not be compelled to bid for all business offered via further competition. It is recognised that not all Call Off Contracts will necessarily suit every Framework Provider because of the type of services / works required. Not all routes above are applicable to all lots Individual Call off Contracts may be of any reasonable duration regardless of when they commenced, i.e., an individual call off contract may outlive the expiry of the Framework Lot itself. However, given the nature of the works being sourced, it is anticipated that the duration of most individual call off contracts will last no longer than one year. The Council intends that all call-off competitions and other framework activities will be managed through its E-Procurement system.
