The subject matter of the contract is the purchase of Rail Baltica regional passenger Rolling Stock with accompanying services, as well as Rolling Stock Unit Option. The Technical Specification is attached (Annex 1). Each contracting authority (Elron, LTG, Vivi) will enter into a separate contract with the successful tenderer. LTG and Vivi will not enter into an actual order of Rolling Stock, but secure an Option for Rolling Stock according to the same Technical Specification and General Terms (Annex 2) as Elron, except for the Main Terms of the respective contracting authority (Annexes 2.1, 2.2 and 2.3).

Käesolevat riigihanget ei jaotata osadeks, kuna hankelepingu ese moodustab tehniliselt, funktsionaalselt ja projektijuhtimise vaates ühtse terviku. Hankelepingu täitmine eeldab ühtset nõuete haldamist, ühtset projektijuhtimist, ühtset kvaliteedi- ja riskijuhtimist, ühtset valideerimist ning koordineeritud sõidukite autoriseerimist. Riigihanke osadeks jaotamine looks olulised liideste, vastutuse hajumise, koordineerimise ja vastavuse tõendamise riskid ning võib seeläbi kahjustada hanke eesmärgi tõhusat saavutamist. Seetõttu ei ole riigihanke osadeks jaotamine käesoleval juhul objektiivsetel tehnilistel ja korralduslikel põhjustel põhjendatud.

This procurement is not divided into lots because the subject matter of the contract constitutes a single whole from a technical, functional, and project management perspective. Performance of the contract requires unified requirements management, unified project management, unified quality and risk management, unified validation, and coordinated vehicle authorisation. Dividing the procurement into lots would create significant interface, fragmented responsibility, coordination, and compliance demonstration risks and could thereby undermine the effective achievement of the objectives of the procurement. Therefore, in this case, dividing the procurement into lots is not justified for objective technical and organisational reasons.
