Procurement Act 2023
Direct award The public contract concerns the supply of goods, services or works by the existing supplier which are intended as an extension to, or partial replacement of, existing goods, services or works in circumstances where - (a) a change in supplier would result in the contracting authority receiving goods, services or works that are different from, or incompatible with, the existing goods, services or works, and (b) the difference or incompatibility would result in disproportionate technical difficulties in operation or maintenance. London Underground Limited intends to directly award a contract to Kirow Ardelt GmbH for the provision of Original Equipment Manufacturer (OEM) spare parts, technical support services and training associated with London Underground's existing Kirow 250 cranes, Switch-Tilt wagons and associated engineering vehicles. A change of supplier would result in services, support arrangements and replacement components that are different from, or incompatible with, the existing assets and established maintenance and assurance framework. Kirow Ardelt GmbH retains responsibility for the technical documentation and engineering assurance processes necessary to support the continued operation of the assets. The Engineering Vehicle fleet is critical to the delivery of Modular Points and Crossings (MPaC) works and wider infrastructure maintenance activities across the London Underground network. Continued access to compatible OEM support, technical expertise and replacement components is required to maintain fleet availability and operational capability.
