The main site at the Golden Jubilee Hospital comprises of a JCI BMS which operate on Legacy N2 communication networks. Public Contracts Regulations 2015 (Directive 2014/24/EU)
Award procedure without prior publication of a call for competition Under Regulation 33(b)(ii) of the Public Contracts (Scotland) Regulations 2015, competition is absent for technical reasons. The National Waiting Times Centre Board (Golden Jubilee) is satisfied that Johnson Controls is the only provider capable of meeting the Board's requirements for the replacement of the existing controllers on site. The installed system comprises Johnson Controls DR field controllers operating on the proprietary N2 communications network. Recovery and migration of the existing controller applications, control strategies and operational parameters requires access to proprietary Johnson Controls software and licences that are not available to third parties. As the original system manufacturer, Johnson Controls is uniquely able to extract and migrate the live controller software whilst maintaining system integrity and operational continuity. Engagement of an alternative supplier would necessitate reverse engineering and re-creation of the existing applications, introducing disproportionate technical risk and the potential for loss of functionality. The Board is therefore satisfied that no reasonable alternative or substitute exists.
