The Eurosystem Procurement Coordination Office (EPCO) established by the Governing Council of the European Central Bank (ECB) by Decision of the ECB of 17 November 2008 laying down the framework for joint Eurosystem procurement (Decision ECB/2008/17 as amended by Decision ECB/2015/51 and ECB/2020/27 ) to coordinate joint procurements, currently hosted by the Banque centrale du Luxembourg. Responses to questions regarding the procedure, as well as all communication between the parties involved and the contracting authority, shall take place exclusively via the German Procurement Portal at https://www.dtvp.de. Interested parties are therefore obliged to check their inbox on the procurement platform regularly to see whether any messages have been received. The contracting authority may refrain from answering questions from tenderers that are not submitted via the procurement portal. 2. Any questions from interested companies must be submitted via the aforementioned procurement portal by the specified deadline for questions. The contracting authority reserves the right not to answer any enquiries received after this deadline. To ensure equal treatment of tenderers, questions regarding the procurement procedure will only be answered in writing and in an anonymised form; 3. The forms provided for this purpose, which can be accessed via the procurement portal, must be used for the tender; 4. Tenders must be submitted via the procurement platform in the relevant project room using the tenderer tool under the "Tenders" tab. Tenders submitted in any other way, in particular written tenders or tenders by email, are not permitted. Tenders must not be submitted via the messaging function of the tendering tool; 5. The tenderer must familiarise themselves in good time with the tendering platform's functionality for submitting tenders and keep themselves informed of any maintenance work on the tendering platform (downtime). Please note that file attachments may only be uploaded up to a certain size. In the event of disruptions to the procurement platform, the tenderer must contact the platform operator's support team and, at the same time, inform the contracting authority; 6. Where parts of the tender documents to be completed by the tenderer require a signature and company stamp, the following applies in the case of electronic submission in text form: instead of an original signature and company stamp, only the name of the natural person making the declaration must be provided. This may also be done by means of a scanned signature. 7. The language of the procedure is German and/or English. Consequently, only information and supporting documents in German and English will be accepted (with a German or English translation where necessary); 8. The wording of the contract notice in the Official Journal of the EU shall be solely authoritative. 9. The contracting authority reserves the right to exercise its right to request additional information.
Under this framework agreement, the Contractor undertakes to deliver SAF Certificates pursuant to the technical specifications outlined in Annex 1. Besides the BBk, the institutions that are participating members of the Eurosystem Procurement Coordination Office (EPCO) hereinafter referred to as "PEMs" (participating EPCO members)) shall be entitled, pursuant to paragraph 2 "Opening clause for members of the Eurosystem Procurement Coordination Office (EPCO)" of this Framework Agreement, to procure the goods and services included in this framework agreement. To this end, the Lead Central Bank (BBk) shall conclude framework agreements with up to five (5) economic operators. In the event that the evaluation for the bids ranked 5th and following are identical, the number of contractors will be increased. During the term of the agreement, individual purchase orders shall be awarded through mini competitions that are generally held individually by each participating institution. The Lead Central Bank (BBk) shall be able to amend the specifications of the SAF Certificates during the term of the agreement and request changes to the portfolio (addition and removal of different types of SAF Certificates). This is particularly the case when changes are required due to technical development or legal requirements. In the event of any amendments, the Contractor shall be notified of the estimated quantity and provided with the specifications. This may be preceded by a request for a quality check/testing pursuant to No 7 upon request. The Contractor shall be able to refuse amendments to the agreement where provision is considered technically impossible, unreasonable or incompatible with its resources. In such cases, the Contractor shall notify the Lead Central Bank (BBk) thereof without undue delay. For furhter information see B1_Framework Agreement_26-2000079740 Article 15.2
