This Contract Award Notice is acting as a Modification Notice under Article 72 of 2014/24/EU to RFT ID 144083 Contract - River Camac Flood Alleviation Scheme published on the previous eTenders system, prior to the introduction of new TED eForms.
A contract was awarded to AECOM Ireland Ltd on 07/10/2019 at a value of €193,196 for Stage 1 and Stage 2 AECOM Ireland Ltd was appointed Scheme Design Consultant to complete Stage 1 and Stage 2 of the River Camac Flood Alleviation Scheme (RCFAS), with an option to extend to Stage 5. AECOM was also appointed Project Supervisor Design Process (PSDP). AECOM was appointed following a Mini Competition (RFT-144083) managed on etenders with participants from Dublin City Council’s Flood Consultant’s Framework (RFT ID – 116671). The scheme has required several modifications to aid the progression of Stage 1 and Stage 2. The changes resulted in addition of work to the Consultant’s Brief, and associated increases in contract costs and programme delivery timeline. The modifications generally relate to refinement of the consultant’s integrated catchment hydraulic model due the complexity of the River Camac Catchment, additional input surveys and survey supervision, website maintenance and consultation, hydrology refinement, project management and administration prolongation costs, and stakeholder engagement. There were 38 modifications made to the contract. Changes are made in accordance with Section 11 Client Changes of the Standard Conditions for Consultancy Services (Technical) (COE1). There were 38 modifications made to the contract. All individual modifications are less than 50% of the initial contract value. The modifications increased the contract value by €390,000 (EX VAT). The modifications to the contract are made in accordance with Article 72.1 (b). Contracts and framework agreements may be modified without a new procurement procedure in accordance with Directive 2014/24/EU. 1(b) for additional works, services or supplies by the original contractor that have become necessary and that were not included in the initial procurement where a change of contractor: (i) cannot be made for economic or technical reasons such as requirements of interchangeability or interoperability with existing equipment, services or installations procured under the initial procurement; and (ii) would cause significant inconvenience or substantial duplication of costs for the contracting authority. However, any increase in price shall not exceed 50% of the value of the original contract. Where several successive modifications are made, that limitation shall apply to the value of each modification. Such consecutive modifications shall not be aimed at circumventing this Directive. The complex hydraulic computer modelling required for this catchment has driven the bulk of the modifications to date. The delivery of a reliable hydraulic model to accurately model flooding in the Catchment is a necessity to progress the River Camac Flood Alleviation Scheme. The development of a reliable hydraulic computer model for the catchment is not complete. It would be technically difficult to try to hand this work package over to another Supplier. This coupled with the possible need for another supplier to create their own hydraulic computer model would set the project schedule back considerably and duplicate the associated costs to the contracting authority. This would have significant economic impacts, and it would cause significant inconvenience to the contracting authority. Dublin City Council confirms that the value of each modification does not exceed 50% of the original contract value.
