Overview

This Contract Award Notice is acting as a Modification Notice under Article 72 of 2014/24/EU to RFT ID 220221 Contract / Framework Agreement for Ground Investigations published on the previous eTenders system, prior to the introduction of new TED eForms. Modifications became necessary to the original Contract, that were not included in the initial procurement, due to additional requirements requested by Irish Rail. These changes are summarised as follows: 1) Alternative excavation method required in rail track area – vacuum suction in lieu of standard excavator 2) Specialised track monitoring required for GI works in close proximity to rail line 3) Topographic survey 4) Additional site mobilisation / site establishment under this Ground Investigation Contract 5) Additional boreholes drilling depths 6) Additional tracing of an existing service 7) Additional macadam surfacing required in the area beneath the rail overbridge on public safety grounds 8) Provision, installation and monitoring data loggers at borehole locations to measure ground water levels 9) Additional laboratory testing of bore hole sampling materials 10) Additional laboratory testing including point load testing, compressive tests and petrography analysis Dublin City Council are relying on Article 72.1(b) of the Directive 2014/14/EU for this modification which states that for additional works, services or supplies by the original contractor that have become necessary and that were not included in the initial procurement where a change of contractor:** (i) cannot be made for economic or technical reasons such as requirements of interchangeability or interoperability with existing equipment, services or installations procured under the initial procurement; and** (ii) would cause significant inconvenience or substantial duplication of costs for the contracting authority.** However, any increase in price shall not exceed 50 % of the value of the original contract. Where several successive modifications are made, that limitation shall apply to the value of each modification. Such consecutive modifications shall not be aimed at circumventing this Directive.”** The value of this modification is €20,714.65. This does not exceed 50% of the original contract value.
