To ensure equal conditions for all Bidders, Tender Proposals must be submitted in Ukrainian hryvnias, exclusive of VAT, with the proposed price also stated as a mandatory equivalent amount in US dollars (USD). The corresponding USD equivalent of the Tender Proposal price will be used to compare the financial proposals received. If the Bidder is successful, this USD equivalent will be used as the fixed reference amount in the contract in order to mitigate the risk of delayed or incomplete performance caused by exchange-rate fluctuations. All payments under the contract with the successful Bidder will nevertheless be made exclusively in Ukrainian hryvnias.

Tender Proposals may be submitted only by business entities (legal entities and individual entrepreneurs) that are either: residents of Ukraine, incorporated and operating in one of the legal forms recognised under Ukrainian law; or legal entities that are non-residents of Ukraine. IMPORTANT: A non-resident Bidder must have an official representative office or an official partner in Ukraine and must provide documents confirming that such cooperation will remain valid for a period of at least the full term of the contract to be entered into with the successful Bidder, including the 6-month warranty period. Such a Tender Proposal must contain information and documentation relating to both legal entities. If the joint Tender Proposal is successful, the contract will be entered into with the legal entity registered in Ukraine.
