Overview

Modalitate de îndeplinire: completare DUAE de către toți operatorii economici, urmând ca documentul justificativ, respective Autorizația de distribuție angro emisă de Ministerul Sănătății – Agenția Națională a Medicamentelor și Dispozitivelor Medicale, pentru activitatea de depozitare, distribuție și comercializare pentru produsul/produsele ofertat/ofertate, în conformitate cu Legea nr. 95 art. 800 din 14 aprilie 2006 privind reforma în domeniul sănătății, cu modificările și completările ulterioare și Ordinul Ministerului Sănătății Publice nr. 1964/2008 pentru aprobarea Normelor privind înființarea organizarea și funcționarea unităților de distribuție angro de medicamente de uz uman să fie prezentate numai de ofertanții clasați pe primele trei locuri, în clasamentul intermediar întocmit la finalizarea evaluării financiare. Justificare: Prin solicitarea îndeplinirii acestor cerințe, autoritatea contractanta dorește să se asigure că operatorii economici sunt înregistrați conform legislației din țara de origine și că au dreptul legal de a desfășura activități economice care să corespunda cu obiectul acordului-cadru. Documentele se vor semna cu semnătură electronică extinsă și se vor posta în SEAP. Cerința se aplică inclusiv pentru subcontractanți, daca este cazul, care completează informațiile aferente situației lor la nivelul unui DUAE distinct. Modalitate de îndeplinire: În vederea demonstrării îndeplinirii criteriului privind capacitatea de exercitare a activității profesionale ofertantul/subcontractantul va completa DUAE – „Criteriile de selecție” - Secțiunea A „Capacitatea de a corespunde cerințelor” – „Înscrierea în Registrul Comerțului”. La solicitarea autorității contractante doar ofertanții clasați pe primele 3 locuri în clasamentul intermediar rezultat după aplicarea criteriului de atribuire asupra ofertelor admisibile, vor prezenta documentele justificative care probează îndeplinirea celor asumate prin completarea DUAE. Aceste documente sunt: Pentru persoanele juridice/fizice române: Se va prezenta certificat constatator emis de Oficiul Registrului Comerțului de pe lângă Tribunalul competent, în original/copie legalizata/copie lizibila cu mențiunea „conform cu originalul”. Informațiile cuprinse în certificatul constatator trebuie să fie reale/valide la data prezentării acestuia. Obiectul contractului trebuie sa aibă corespondent in codurile CAEN din certificatul constatator emis de Oficiul Registrului Comerțului, iar ofertantul trebuie să fie autorizat sa desfășoare activitățile aferente contractului, conform art. 15 din Legea nr. 359/2004. Pentru persoane juridice/fizice străine: Se vor prezenta documente echivalente care sa dovedească forma de înregistrare/autorizare ori apartenenta, din punct de vedere profesional în condițiile legii din tara de rezidentă, din care sa rezulte că operatorul economic este adecvat constituit, că nu se află în niciuna din situațiile de anulare a constituirii si că are capacitatea profesională de a realiza activitățile care fac obiectul prezentului contract în corelare cu cerințele mai sus menționate si reglementările aplicabile în tara de origine/ tara în care operatorul economic este stabilit, în limba în care au fost emise, în copie lizibila cu mențiunea „conform cu originalul”, însoțite de o traducere autorizata a acestora în limba română. Obiectul acordurilor-cadru trebuie sa aibă corespondent în domeniile de activitate înscrise în documentele prezentate. Informațiile cuprinse în aceste documente trebuie sa fie reale/valide la data prezentării acestora. NOTE: - în cazul participării cu oferta comuna (a unei asocieri), se vor prezenta documente pentru fiecare dintre membrii asocierii pentru partea de contract pe care o realizează; - în situația în care vor fi executate părți din contract de către subcontractanți, dovada înregistrării și corespondența activităților principale/secundare din cadrul acestuia cu obiectul achiziției se va prezenta obligatoriu și de către subcontractanți, pentru partea din contract pe care o vor realiza. Subcontractanții trebuie sa fie autorizați să desfășoare activitățile aferente contractului, conform art. 15 din Legea nr. 359/2004.
