Procurement Act 2023
Competitive flexible procedure
The Framework enables Clients to appoint Framework Partners for projects within the defined Lot project value ranges and locations to deliver works. Clients may award Call Off Contracts either as an Award With Competition (Mini Competition) or an Award Without Competition (Direct Award) 1. Mini Competition Clients may undertake a mini competition under the appropriate geographic and value range Lot, whereby they structure their competition in a manner that satisfies the requirements of Section 46 of the Procurement Act 2023. Clients may have multiple stages (down-selection), utilise negotiation and assess Framework Partners quality and price/cost in a manner that they believe best enables them to achieve the Most Advantageous Tender. As such, Clients are able to set the evaluation criteria in accordance with the appropriate themes described in the Construction Playbook and set the evaluation weightings appropriate to the requirements of the Call Off Contract. 2. Direct Award Clients may Direct Award a Call Off Contract under the appropriate geographic and value range Lot by either: Objective Mechanism One which permits an award of a Call Off Contract whereby the Client can comply with any of the provisions of Sections 41, 42 or 43 of the Procurement Act 2023 or Schedule 5 of the Procurement Act in relation to Single Supplier, Additional or Repeat Goods, Services or Works, or Urgency. Alternatively Objective Mechanism Two which permits an award of a Call Off Contract whereby the Client awards the Call Off utilising the scores achieved in the Framework procurement and or the performance under the framework to a Framework Partner who is able to deliver the project within the Clients timescales. The Client shall select the criteria most appropriate to its project which may be one of the following: - Award based on a mix of quality and price: balanced approach to the ITT quality and price scoring - Award based on price: highest scoring ITT price score - Award based on quality: highest scoring ITT quality score - Award based on performance against the Framework Performance Management (KPIs): Highest KPI score In the event that the Framework Partner who has been selected by the Client by application of one or more of the options under Objective Mechanism Two is unable to deliver the works, the Client may then award to the second highest ranking Framework Partner following written confirmation.
