The Engagement is divided in four (4) Lots and involves the delivery of expertise, competence and resources in the field of IT (run and change) for the IT & Data departments within the Contracting Party. The Contracting Party is initially looking for partners who can meet the need for additional capacity, projects, maintenance and resources to staff the teams of the IT & Data departments and to possibly scale them up. However, the Contracting Party expects more from the partners than just providing capacity, as they should understand and convey the objectives and strategy of the IT & Data departments within the Contracting Party as mentioned in Appendix 1a and be able to deliver real business value for the Contracting Party. In addition, the partners shall make a concrete contribution to realizing the strategy of the IT & Data departments with their knowledge and expertise.
Schiphol Nederland B.V. (SNBV) hereby informs you that the European tender procedure for Framework Agreements regarding Partners on IT & Data (T155280), published on June 3, 2025, is being withdrawn. After careful analysis, SNBV concludes that suitability requirement SR1 Parent / group guarantee (as set out in paragraph 5.1 of the Selection Guidelines) is detrimental to potentially interested market parties and candidates that are consulting companies forming part of an accounting firm. SNBV has assessed that the obligation of a candidate to have its parent/group company issue a parent company/group guarantee to SNBV, may conflict with professional and supervisory regulations for accounting firms and statutory auditors and general corporate law and financial regulations. As a result, potentially interested market parties and candidates that are bound by such laws and regulations cannot, in all cases, comply with suitability requirement SR1 and provide the requested parent company or group guarantee. As a result, these potentially interested market parties and candidates are not able to participate in the tender procedure or would be excluded because of non-compliance with this suitability requirement. SNBV has assessed the maintenance of SR1 as potentially conflicting with the procurement principles of equal treatment and non-discrimination of economic operators. SNBV has assessed that an amendment of suitability requirement SR1, seeing to the allowance of an alternative form of security, is a material change (wezenlijke wijziging) within the meaning of clause 2.163g of the Dutch Procurement Act 2012 and as such not allowed. In order to be able implement such a material change, SNBV is obliged to withdraw the tender and republish it in a substantially changed form, namely by allowing candidates an alternative form of security and as such the choice between the issuance of a declaration of joint and several liability within the meaning of Section 2:403 of the Dutch Civil Code (‘403-declaration’) or a parent company/group guarantee. The 403-declaration is a financial guarantee. This means that the scope of the parent company/group guarantee will have to be limited to a financial guarantee too. As a result the Standard Form of Parent Company / Group Guarantee as provided with the tender documents will be amended in line with this as well. We realize that this decision may have consequences for those Candidates that were already involved and regret any inconvenience this causes. A revised tender will be announced again within the upcoming week (week nr. 33), allowing all interested parties including the parties already involved the opportunity to submit an application. After expiry of this period, the decision to withdraw will be deemed final and reactions or objections will not be taken into consideration.
