Procurement Act 2023

Direct award This decision is in line with Schedule 5, Direct Awards, utilising Paragraph 5 of the Procurement Act 2023. This procurement route aligns with this principle because of the Intellectual Property Rights that the Institute of Public Care (on behalf of Oxford Brookes Enterprises Limited) hold. These intellectual property rights are important to the Evaluation and Research Development Activities contract and the work that is being delivered by Institute of Public Care (on behalf of Oxford Brookes Enterprises Limited). As the supplier holds the relevant exclusive rights, it is the only provider able to deliver these services, and no reasonable alternatives exist. This provides a clear and transparent justification in accordance with the Procurement Act 2023. The decision therefore aligns with the Act’s core objectives while appropriately acknowledging the supplier’s exclusive rights.
